TERMS & CONDITIONS 

 

I understand that this event is a rain-or-shine event and that if I am accepted and cancel, I will forfeit payment. I will set up and take down my space during the designated times unless otherwise arranged with the organizer. I will abide by all rules set out by the organizer and will discuss any concerns privately with the event organizer directly.

CONTRACT: Doggie Fest Toronto reserves the right to exercise its sole discretion in the acceptance or refusal of applications. This application for space when, and if, accepted by the Management shall constitute a contract between the Exhibitor and the Management and in addition to its terms, shall include and incorporate the Exhibitor’s Rules and Regulations printed on this application,

QUALIFICATIONS TO EXHIBIT: The Management reserves the right to remove, decline, or prohibit any exhibit or part of an exhibit, or proposed exhibit, which in its opinion is not suitable to or in keeping with the character of the exhibition. Management reserves the right to close down and remove immediately any exhibitor and exhibit from the show. * Exhibitors may be asked to remove the product and or service from their booth/spot if it was not pre-approved by the Management.

PAYMENTS: Applications for space received by Management must be accompanied by a non-refundable etransfer or credit card payment for the total cost of the space selected. Payment must follow an emailed application. Vendor spots are not reserved until FULL payment is received. No refunds or cancellations will be reimbursed.

EXHIBIT SPACE RENTAL: Exhibitor is responsible for setup of their exhibit space. Exhibitor is responsible for cleaning up their area upon tear down.

LOCATION OF EXHIBIT: The Exhibitor agrees to confine their presentation within the contracted space only, and within the maximum height set by the show rules and regulations, and to maintain a staff in their booth space during show hours. Management reserves the right to relocate an exhibitor, as it shall deem necessary to the proper conduct of the Exhibition.

EXHIBITOR’S INFORMATION: The Management will email to each Exhibitor Information which shall contain a copy of the Operational Rules. It will contain move-in, show hours, and move-out from the Exhibition.

 

PROPERTIES: No exhibitor or feature area sponsor will be permitted to utilize the titles, names or phrases associated with any Doggie Fest Toronto feature area as part of their exhibit, unless they have signed and financially committed to Sponsor that specific feature area.

LAWS, RULES AND REGULATIONS: All pertinent fire code, laws, ordinances and regulations pertaining to health, fire prevention and public safety shall be strictly obeyed. The vendor agrees to keep all merchandise, chairs, and other equipment within the marked boundaries of the booth.

EXHIBIT INSTALLATION/REMOVAL: The Exhibitor agrees that no display may be dismantled or goods removed during the entire run of the show, but must remain intact until after the closing time of the show. The Exhibitor also agrees to remove the exhibit and equipment from the show building by the final move-out time limit (as set by the show rules and regulations), or in the event of failure to do so the exhibitor agrees to pay for such additional costs as may be incurred.

SUBLETTING OF SPACE: Subletting of exhibit space is prohibited. The Exhibitor may not sublet a portion, the whole or any part of the exhibit space allocated by Show management to the Exhibitor.

CANCELLATION OF CONTRACT: The Management reserves the right to terminate this contract and to withhold from the Exhibitor possession of the exhibit space if: (a) the Exhibitor fails to pay all space rental charges upon arrival at the Festival or (b) the Exhibitor fails to perform any terms and conditions of the contract.

 

REFUND: Exhibitors shall not be entitled to a refund of any fee should the Exhibitor for any reason be unable to Exhibit at the event or cancel any space previously contracted.

POSTPONEMENT OR CANCELLATION BY MANAGEMENT: The Management reserves the right to postpone or cancel the exhibition at its discretion. All monies will be refunded to Sponsors and Exhibitors. The option to participate in future exhibitions is at the discretion of the Sponsor/Exhibitor.

INSURANCE: The Exhibitor is solely responsible for the placement and cost of comprehensive liability insurance on products and completed operations at events.

​

DAMAGES: The Management shall not be liable for any damages, whether direct, indirect, general, special, consequential or otherwise to the Exhibitor, its agents and employees or visitors to its exhibit whether occasioned by Management, its officers, agents or employees, or by another Exhibitor.

​

NON-DELIVERY OF THE PROPERTY: The Management will not be liable for failure to deliver the space in the event of the property becoming unavailable through fire, act of God, strikes, the authority of the law, or any other cause beyond its control.

INTERPRETATION OF REGULATIONS: The Management has the right to make such changes, amendments, and additions to these Exhibitor’s Rules and Regulations, as it shall deem necessary to the proper conduct of the Exhibition and thereupon the Exhibitor’s Rules and Regulations and the Operational Rules shall rest with the Management and its decision shall be final. Management may require Exhibitors to make such alterations to their displays, as it deems necessary to the proper conduct of the exhibition and, on failure to comply, may order the immediate removal of the entire exhibit without compensation and at the exhibitor’s expense.

 

PETS AT BOOTH: I agree to the following: I acknowledge that my pet is up-to-date on all age-appropriate vaccinations, is not of an aggressive nature, is not in heat and to the best of my knowledge, is free from any diseases or conditions that would make it a danger to any participant, spectator or any individual. Without exception, I accept full financial responsibility for any damage to persons or properties as a result of my pet’s actions at Doggie Fest Toronto. I understand that Doggie Fest Toronto, its owners, employees, managers, officers, volunteers, and any other individuals involved with the production of this event, reserves the right to refuse admittance to any unruly, aggressive, unsuitable or blatantly ill pets as well as ask me to remove my pet from the event if it displays behaviours that are deemed to be disruptive or dangerous. I affirm that I am the ONLY one responsible for my pet and I agree to indemnify and hold harmless any other person, company or organization from any liability resulting from my pet’s attendance at Doggie Fest Toronto. All animals must be leashed, or contained within a secure, fenced area in the booth space.

 

HOLD HARMLESS AGREEMENT: I shall indemnify and hold harmless Doggie Fest Toronto, their members, agents, and employees from and against all claims, demands, losses, costs, damages, suits or proceedings by any third parties that may arise out of or may be attributed to all operations performed by or carried out by Doggie Fest Toronto, their agents, employees or anyone for whose acts they may be held liable howsoever caused. The applicants shall be responsible for the conduct of the participants or personnel working in their display and agree no rule, regulation or condition governing the use of the facilities is contravened. The applicant acknowledges having read this Agreement before signing and agrees to abide by the terms of the Agreement, the Rules and the Regulations. I hereby affirm that I have read and do understand all instructions and guidelines in the Doggie Fest Toronto Exhibitor Application and Information Package. I agree to comply with all Doggie Fest Toronto rules/guidelines and understand that my failure to do so will result in my removal from the festival activities with NO REFUND.
